NOTICE OF PUBLIC HEARING FOR OCP/ZONING BYLAW AMENDMENT AND ALR EXCLUSION

Notice is hereby given that an electronic/telephone Public Hearing will be held on Monday, June 10, 2024 at 6:00 P.M. regarding the following:

• “Smithers Telkwa Rural Official Community Plan Bylaw No. 1704, 2014” (the OCP) is proposed to be amended by Bylaw No. 2030, 2024, which would redesignate a ±5 ha portion of the subject properties from the Agriculture (AG) designation to the Rural Residential (RR) designation and amend the text of the RR designation;

• “Regional District of Bulkley-Nechako Zoning Bylaw No. 1800, 2020” (the Zoning Bylaw) is proposed to be amended by Bylaw No. 2031, 2024, which would rezone a ±5 ha portion of the subject properties to the Multiple Family Residential Zone (R2) and amend the text of the R2 Zone.

• The Regional District of Bulkley-Nechako may make application to the Agricultural Land Commission (ALC) to exclude a ±5 ha portion of the subject properties from the Agricultural Land Reserve (ALR).

The purpose of the proposed bylaws and ALC exclusion application is to allow a total of up to 21 dwelling units on the subject properties and facilitate the potential legalization of 17 existing dwellings.

The subject properties are located at 3336 to 3500 Poplar Road at the corner of Highway 16 and Babine Lake Road approximately 4 km from the Town of Smithers. The subject properties are legally described as “Block C, Section 16, Township, 4, Range 5, Coast District, Plan 6397, Except Plans 8749 and PRP47360” and “Lot 1, Section 16, Township 4, Range 5, Coast District, Plan PRP47360”, and are shown shaded in grey and labelled “Subject Properties” on the map below. The area proposed for redesignation, rezoning, and ALR exclusion is labelled as the “Proposed Exclusion Area”.

At the Public Hearing, all persons who believe that their interest is affected by the proposed bylaws or the ALR exclusion application shall be afforded a reasonable opportunity to be heard.

Any person wanting to participate in the Public Hearing must contact the RDBN Planning Department no later than Monday, June 10, 2024 at 1:00 P.M. to receive instructions regarding video conferencing or telephone participation at the Public Hearing.

Written submissions to the Public Hearing must be sent by mail to P.O. Box 820, Burns Lake, BC, V0J 1E0; or by e-mail to planning@rdbn.bc.ca and must be received by the Regional District of Bulkley-Nechako no later than Friday, June 7, 2024 at 4:30 P.M. to be ensured of consideration at the Public Hearing.

The Public Hearing will be chaired by the Director or Alternate Director for Electoral Area ‘A’ (Smithers Telkwa Rural) as a delegate of the Board. A copy of the Board resolution making the delegation, copies of the proposed bylaws, relevant information relating to the bylaws and proposed ALR exclusion, and written submissions to the Public Hearing, may be inspected from May 29, 2024 to June 10, 2024 at the office of the Regional District of Bulkley-Nechako or the Town of Smithers municipal office between the hours of 8:30 AM - 4:30 PM, Monday through Friday, excluding holidays or online at www.rdbn.bc.ca/departments/planning/public-meetings.
